MAKYEE Terms and Conditions

These Terms and Conditions ("Terms") govern your use of the website www.makyee.com (the "Site") and the services provided by Makyee Real Estate Brokerage LLC ("Makyee", "we", "us", or "our"). By accessing or using the Site or our services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Site or our services.

1. Use of the Site

1.1. You must be at least 18 years old and have the legal capacity to enter into contracts to use the Site and our services. By using the Site or our services, you represent and warrant that you meet these requirements.

1.2. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

1.3. You agree to use the Site and our services only for lawful purposes and in accordance with these Terms and all applicable laws and regulations.

2. Services

2.1. Makyee provides an online platform that facilitates the buying and selling of properties for investors, buyers, and sellers worldwide. We offer various services in line with DLD Rules and Regulations, including property listings, transaction facilitation, and related services.

Users

To complete your verification and gain full access to all features, you must first complete the registration process and submit all required documents. Once your registration is complete and the necessary documentation is provided, your account will be fully verified, granting you access to additional features and benefits.

Buyer

Makyee has established distinct categories of buyers to streamline the registration and verification process. These categories include: Individual, Corporate and Multiple Buyers. Each category has specific documentation and verification requirements to ensure a smooth registration experience.

Seller

Makyee also offers various categories for owner types, allowing you to select from Individual, Corporate and Multiple Buyer options. Each category comes with its own set of required documents tailored to the specific needs and legal requirements of the owner type. These documents are necessary for processing your request and ensuring compliance with all relevant regulations.

3. Subscriptions

3.1 You will initially be given the Essential subscription by default. However, if you wish to list two or more items , you will need to upgrade to a higher subscription tier, such as Advanced or Premium. The cost for these upgraded subscriptions will vary based on the duration of your subscription, with pricing determined by the number of months you choose to maintain your plan. The Advanced or Premium tiers offer additional features and benefits tailored to users who require more listing capabilities, making them ideal for those looking to expand their presence.

3.2 Users are not eligible for refunds in the event of cancelling a listing with us. This policy also applies to Makyee Plus subscriptions and Boosting features.

4. Features

Makyee has developed a variety of powerful features designed to enhance the user experience and help you maximize the visibility of your listings. One of the standout features is the Boosting option, which allows you to promote your property listings for greater exposure. You can easily set a daily budget and choose the duration for the boost. The higher the budget you allocate, the greater the chances your listing will appear at the top of search results, increasing its visibility to potential buyers.

In addition to boosting your listings, the Makyee platform also provides a comprehensive set of tools to manage your listings directly through the app. You can edit, unpublish or delete your listings as needed, giving you full control over your property information. However, please note that any changes made to your listing will be subject to review by the Makyee admin team to ensure compliance with platform standards and policies.

With these features, Makyee gives you the flexibility to manage and promote your properties effectively, helping you reach a wider audience and maintain control over your listings.

5. Payment Terms

Makyee provides a range of payment options for your convenience, including Cash, Bank Transfer, Cheque, and Legal Cryptocurrencies.

As per DLD Rules and Regulations, the down payment check is held as a deposit by Makyee, such that the broker is not allowed to dispose of the check or cash it without obtaining a written order from both the buyer and the seller. In case of any dispute, the down payment amount cannot be returned to either party unless a judicial order is obtained to determine which party is entitled to the down payment amount.

For primary properties, if the buyer decides not to proceed with the transaction after paying the down payment, Makyee will coordinate with the developer to process the refund. The refund will be issued to the buyer within two weeks or longer, depending on the developer's timeline.

6.User Content

6.1. You may have the opportunity to submit or upload content, such as property listings, reviews, comments, or other materials (collectively, "User Content"), to the Site.

6.2. You represent and warrant that you own or have the necessary rights, licenses, consents, and permissions to submit the User Content and to grant the rights granted herein.

7. Intellectual Property

7.1. The Site and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by Makyee or its licensors and are protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

7.2. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Site without our prior written consent, except as necessary for your own personal, non-commercial use or as permitted by applicable law.

8. Limitation of Liability

8.1. To the fullest extent permitted by law, Makyee and its affiliates, officers, directors, employees, agents, licensors, and service providers shall not be liable for any direct, indirect, incidental, consequential, special, punitive, or exemplary damages, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or in connection with your use of the Site or our services.

9. Indemnification

9.1. You agree to indemnify, defend, and hold harmless Makyee and its affiliates, officers, directors, employees, agents, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Site or our services.

10. Governing Law and Jurisdiction

10.1. These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates, without giving effect to any conflict of law principles. Any dispute arising out of or relating to these Terms or your use of the Site or our services shall be exclusively resolved by the courts located in Dubai, UAE.

11. Changes to these Terms

11.1. We may update or modify these Terms from time to time in our sole discretion. We will notify you of any material changes by posting the updated Terms on the Site. Your continued use of the Site or our services after the effective date of the updated Terms constitutes your acceptance of the revised Terms.

1. Acceptance of Terms

 

By opting to engage with the Makyee Pro platform, you, the user, acknowledge and agree to adhere to these Terms and Conditions in their entirety. Should you find these terms unacceptable, we at Makyee respectfully ask that you refrain from using our platform. Your understanding and compliance with these guidelines are essential for creating a positive and enjoyable experience for all users.

2. Eligibility

 

To access and fully utilize the Makyee Pro platform, it is essential that you are at least 18 years old and possess the legal capacity to enter into these Terms and Conditions. In addition, you are required to provide the necessary documents for identity verification to ensure compliance with our policies. By choosing to engage with our services, you affirm that you meet these criteria and are fully eligible to participate on the platform.

 

3. Listing Properties

 

3.1 Users have the ability to list properties on the Makyee Pro platform without the requirement of holding a real estate license. This feature allows individuals to showcase their properties effortlessly, enabling them to connect with potential buyers. By removing the licensing barrier, Makyee empower users to engage in the real estate market with greater accessibility and ease.

 

3.2 To list a property, users must upload all necessary documents from the seller, making sure that each document is accurate and complete. This is important for keeping the listing process trustworthy and providing potential buyers with reliable information. By verifying the accuracy of the documents, users contribute to a more reliable marketplace for all.

 

3.3 Makyee retains the right to verify any documents submitted and may request additional information as necessary to ensure compliance and accuracy.

 

3.4 Makyee will safeguard all the property information and won’t be shared to any property search engine or any other agents.

 

4. Commission Structure

 

4.1 Users will receive 100% of the commission from any successful sale transaction conducted through the platform.

 

4.2 Makyee Pro will apply a 1.7% administrative fee on the earned commission from each transaction. This fee helps cover the operational costs associated with providing our services and maintaining the platform, ensuring a smooth and efficient experience for all users. It is deducted from the total commission earned, allowing us to continue delivering high-quality support and features.

 

4.3 Users will receive their commission payment after the deduction of the applicable administrative fee. This ensures that all fees are accounted for before the final amount is disbursed.

 

4.4 Makyee Pro user will receive their commission once the transaction is finalized and the commission status will reflect on the application. Any follow up can be done through our support channels.

 

5. Listing Upgrades and Subscriptions

 

5.1 Users can enhance their property listings through various upgrade features available on the platform. These upgrades may include increased visibility, promotional placements, and enhanced multimedia options.

 

5.2 Makyee Pro may offer subscription plans with pricing dependent on property size. The specific pricing and benefits associated with each plan will be detailed on the platform.

 

5.3 Details regarding available upgrades and subscription plans, including pricing and features, will be provided on the platform.

 

6. Payment Methods

 

6.1 Users can receive payments through various methods, including cash, bank transfer, cryptocurrency, and cheque payments.

 

6.2 Users are responsible for providing accurate payment information and ensuring that they comply with any applicable regulations regarding the chosen payment method.

 

7. Refunds

 

Users are not eligible for refunds in the event of cancelling a listing with us. This policy also applies to Makyee Pro subscriptions and Boosting features.

 

8. User Responsibilities

 

8.1 Users are responsible for the accuracy of all information and documents submitted.

 

8.2 Users must comply with all applicable laws and regulations concerning real estate transactions in their jurisdiction.

 

8.3 Users agree to act in good faith and not to misrepresent any information.

 

9. Limitation of Liability

Makyee is not liable for any damages or losses resulting from the use of the platform, including but not limited to loss of profit, data, or other intangible losses. Users engage with buyers and sellers at their own risk.

10. Termination and Changes to Terms

10.1 Makyee reserves the right to terminate or suspend a user’s account due to violation of Terms.

10.2 Makyee may update these Terms and Conditions from time to time. Any changes will be posted on the platform, and continued use constitutes acceptance of the revised terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates. Any disputes arising from these Terms shall be resolved in the competent courts of the United Arab Emirates.
